MAP Policy
Boosted Mentality Motorsports (BMM) MAP Pricing Policy
Effective Date: August 1, 2024
Introduction
Boosted Mentality Motorsports (BMM) has developed this Minimum Advertised Price (MAP) Policy to ensure the integrity of our brand and to maintain the value of our products in the marketplace. This policy is intended to encourage fair competition among our distributors and resellers and to protect the investment of our customers in BMM products.
Policy Coverage
This MAP Policy applies to all resellers of BMM products, including but not limited to, online retailers, brick-and-mortar stores, and distributors. All products sold by BMM are subject to this MAP Policy.
MAP Pricing
The Minimum Advertised Price for each BMM product is determined solely by BMM and will be communicated to all resellers. Resellers may not advertise any BMM product at a price lower than the MAP established by BMM. The MAP for each product is listed in [insert attachment/link to MAP pricing list].
Advertising Covered by MAP Policy
The MAP Policy applies to all advertisements of BMM products in any and all media, including but not limited to:
- Print media (newspapers, magazines, brochures, etc.)
- Broadcast media (radio, television)
- Direct mail
- Online media (websites, e-commerce platforms, social media, etc.)
- Email marketing
Enforcement
1. Monitoring: BMM will actively monitor the marketplace to ensure compliance with this MAP Policy.
2. Violations: If a reseller is found to be in violation of this MAP Policy, BMM may take the following actions:
- First Violation: Written warning and 48 hours to correct the violation.
- Second Violation: Temporary suspension of the reseller's account or order privileges.
- Third Violation: Termination of the reseller's account and the ability to purchase BMM products.
3. Right to Adjust: BMM reserves the right to modify or suspend the MAP Policy, MAP prices, and/or the list of products covered at any time.
Exceptions
- Promotions: Temporary promotions, including but not limited to in-store promotions, discounts, coupons, or special offers, may be allowed under certain circumstances, but must be pre-approved by BMM in writing.
- Discontinued Products: Products that have been officially discontinued by BMM may be excluded from the MAP Policy. Resellers will be notified of such discontinuations.
Non-Binding Agreement
This MAP Policy does not constitute an agreement between BMM and any reseller or other party, and BMM does not seek, nor will it accept, any agreement or understanding with respect to the pricing of BMM products. The reseller is solely responsible for setting its own retail prices.
